Terms of Service

Plain English Summary: By signing up you agree to these terms. You get a 3-day free trial. After that you pay monthly or yearly. You can cancel anytime. Do not use our platform for anything illegal or harmful. We own the platform but you own your content.

Acceptance of Terms

By accessing or using the Winter Tech AI platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users and clients of the platform.

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Our Services

Winter Tech AI provides subscription-based AI automation tools including:

AI Chatbot — website and messaging platform chatbots
Email Automation — AI-written email sequences and triggers
CRM and Lead Management — lead capture, pipeline and scoring tools
Social Media AI — content generation and scheduling
AI Reports — automated performance reporting
Additional features and tools as described on our pricing page

We reserve the right to modify, suspend or discontinue any aspect of the Service at any time with reasonable notice.

Account Registration

To use the Service you must create an account by providing accurate and complete information. You are responsible for:

Maintaining the confidentiality of your login credentials
All activity that occurs under your account
Notifying us immediately of any unauthorised access
Ensuring your account information remains accurate and up to date

You may not share your account with others or create multiple accounts to circumvent plan limits. Each account is for one business entity.

We reserve the right to suspend or terminate accounts that violate these Terms or are used fraudulently.

Free Trial

We offer a 3-day free trial on all plans. The free trial includes:

Full access to all features of your chosen plan
A limit of 100 chatbot conversations during the trial period
Card required · zero charge for 3 days to start

At the end of the trial period, your account will pause unless you subscribe to a paid plan. No charges are made during the trial. Your account data is preserved for 30 days after a trial expires, then permanently deleted if no subscription is started.

Subscriptions and Billing

Subscription plans

Paid subscriptions are billed monthly or annually as selected at signup. Prices are as listed on our pricing page at the time of purchase. We reserve the right to change prices with 30 days notice to existing subscribers.

Payment

Payment is processed securely by Paddle. By providing payment details you authorise us to charge your selected payment method on a recurring basis. All prices are in USD unless otherwise stated.

Cancellation

You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until then. No partial refunds are issued for unused time within a billing period unless covered by our Refund Policy.

Failed payments

If a payment fails, we will attempt to retry it. If payment remains unsuccessful after reasonable attempts, your account will be paused until payment is resolved. You will receive email notifications about payment failures.

Plan changes

You may upgrade your plan at any time — the new plan takes effect immediately and billing adjusts pro-rata. Downgrades take effect at the next billing cycle.

Acceptable Use

You agree not to use the Service to:

Violate any applicable laws or regulations
Send spam, unsolicited messages or deceptive communications
Harass, abuse or harm individuals
Impersonate another person or entity
Distribute malware, viruses or harmful code
Attempt to access accounts or systems you do not own
Scrape or extract data from our platform without permission
Resell or sublicense the Service without prior written agreement (except Agency Bundle clients)
Use the Service in any way that could damage, overload or impair our infrastructure
Process data in violation of applicable privacy laws (GDPR, CCPA, etc.)

Violation of these terms may result in immediate account termination without refund.

Intellectual Property

Our platform

The Winter Tech AI platform, including all software, design, code, content and trademarks, is owned by Winter Tech AI and protected by intellectual property law. You may not copy, modify, distribute or reverse-engineer any part of the platform without our express written permission.

Powered by badge

Starter and Growth plan clients display a "Powered by Winter Tech AI" badge on their chatbot. Removal of this badge without an appropriate plan upgrade or add-on is not permitted.

Feedback

Any feedback, suggestions or ideas you provide to us about the Service may be used by us without obligation or compensation to you.

Your Content

You retain ownership of all content you upload to the platform — your knowledge base, business information, email sequences, and any other data you provide ("Your Content").

By uploading Your Content, you grant Winter Tech AI a limited, non-exclusive licence to use, store and process that content solely for the purpose of providing the Service to you.

You are responsible for ensuring Your Content:

Does not infringe any third party's intellectual property rights
Does not contain anything illegal, defamatory or harmful
Complies with applicable data protection laws if it contains personal data

Upon account termination, Your Content is deleted in accordance with our data retention policy.

Disclaimers and Limitations

Service availability

We aim for high availability but do not guarantee uninterrupted access to the Service. We are not liable for downtime caused by maintenance, third-party service failures or circumstances beyond our control.

AI accuracy

Our AI tools generate content automatically. AI-generated content may occasionally be inaccurate, incomplete or inappropriate. You are responsible for reviewing AI-generated content before use and for any consequences of deploying it.

Limitation of liability

To the maximum extent permitted by law, Winter Tech AI's total liability to you for any claims arising from the use of the Service shall not exceed the amount you paid us in the 3 months prior to the claim.

We are not liable for indirect, incidental, special, consequential or punitive damages, including lost profits, loss of data or business interruption.

Note: Some jurisdictions do not allow certain liability limitations. In those jurisdictions, the above limitations apply only to the extent permitted by applicable law.

Termination

By you

You may cancel your account at any time from your dashboard settings. Upon cancellation, your access continues until the end of the current billing period, after which your account is paused and data retained for 90 days before permanent deletion.

By us

We may suspend or terminate your account immediately if:

You violate these Terms
Your account is used for fraudulent or illegal activity
Payment remains outstanding after reasonable attempts to collect
Continued provision of the Service poses a legal or security risk

In non-urgent cases we will provide reasonable notice before termination. Where immediate termination is necessary (e.g. for fraud), no advance notice will be given.

Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are based outside the UK, mandatory consumer protection laws in your jurisdiction may also apply alongside these Terms.
